1. Scope and Provider

These Terms of Service (ToS) govern the contractual relationship between Dr. med. Christian Kirsch (hereinafter “Provider”) and users of the EchoMastery Pro web application and mobile app. These terms are subject to the laws of the Federal Republic of Germany.

2. Medical Disclaimer (Essential)

EchoMastery Pro provides educational content and clinical calculators for informational purposes only. It does not constitute medical advice, diagnosis, or treatment. The use of clinical tools within the service does not replace the professional judgment of a qualified healthcare provider.

3. Right of Withdrawal (B2C Consumers)

If you are a consumer (a natural person entering into a contract for purposes mostly outside of their trade, business, or profession), you have a statutory 14-day right of withdrawal.

Withdrawal Period: You may withdraw from this contract within 14 days without giving any reason.

Electronic Withdrawal Button: Starting June 19, 2026, you may exercise this right via the “Withdraw from Contract” button located in our website footer or account settings. This function is available without a login requirement.

Process: Clicking the withdrawal button will lead to a confirmation page; the withdrawal is legally effective once you click the final “Confirm Withdrawal” button. We will immediately confirm receipt via email.

4. Limitation of Liability (German BGB Standards)

The Provider’s liability is limited as follows:

Unlimited Liability: The Provider is liable without limitation for intent, gross negligence, and for injury to life, body, or health.
Essential Obligations: In the event of a slightly negligent breach of an obligation that is essential for achieving the purpose of the contract (Kardinalpflichten), liability is limited to foreseeable, typically occurring damages.
Other Cases: Liability for simple negligence is otherwise excluded.

5. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr/. The Provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
